TERMS OF SERVICE

  1. Scope and legal applicability

These Terms of Service (“Terms”) govern access to and use of the TheBrickBlaster website and online store (“we”, “us”, “our”).
They apply to all users and customers worldwide.

By visiting our website or making a purchase, you agree to be bound by these Terms and by all related policies published on savenor.com (including, without limitation, our Privacy Policy and our Returns, Warranty and Refund Policy).

Nothing in these Terms limits the non-waivable consumer rights granted under the applicable laws of your country of residence or delivery.

  1. Capacity and accounts

You must be of legal age in your country of residence to make a purchase, or have the consent of your legal guardian.

You agree that all information you provide (email address, shipping address, payment details) is true, accurate and up to date.

You are responsible for keeping your account login credentials confidential.

TheBrickBlaster reserves the right to suspend or cancel any account in case of misuse, fraud, or violation of these Terms.

  1. Products and descriptions

We use reasonable efforts to ensure that product descriptions, images and details are accurate and up to date.

However, colors and appearance may vary slightly depending on your screen or device settings.

Prices, descriptions and availability of products may change at any time without prior notice.

  1. Orders and acceptance

When you place an order, you are making an offer to purchase.

The sales contract is considered concluded only when we confirm your order and proceed to ship it.

TheBrickBlaster reserves the right to reject or cancel orders, including but not limited to cases of:

  • lack of product availability,

  • suspected fraud,

  • obvious errors in price or description,

  • incomplete or inaccurate information.

In case of cancellation, any amounts paid for the cancelled order will be refunded.

  1. Prices, taxes and duties

Prices are shown in the currency indicated on the website (by default, euros – EUR – for sales within the European Union) and are valid at the time of purchase.

In Spain and the EU, prices are normally displayed including VAT, unless otherwise stated.

Applicable taxes (such as VAT) are calculated and shown during checkout based on the delivery address.

For international orders outside the EU, customs duties, import taxes and other local charges may apply and will be the customer’s responsibility.

By completing payment, you confirm that you are authorized to use the selected payment method.

  1. Payments

We accept the payment methods shown during the checkout process (credit/debit card, PayPal or others indicated at any given time).

Payment must be authorized and completed before the order is processed.

If payment authorization fails, the order will not be completed or shipped.

  1. Shipping and delivery

Orders are normally processed within approximately 1 to 3 business days from payment confirmation.

Delivery times depend on the destination country, the shipping method selected and the carrier. Estimated delivery times will be shown during checkout.

Whenever possible, a tracking number will be provided.

The risk of loss or damage passes to the customer when the product is delivered to the address provided.

It is the customer’s responsibility to check the condition of the package upon delivery. If it arrives damaged or the product is incorrect, TheBrickBlaster must be notified within 48 hours so we can assist you.

  1. Returns, refunds and warranties

Withdrawal / Change-of-mind returns

We offer a 14 calendar day period from delivery to return unused products in their original packaging, in accordance with the EU right of withdrawal for distance sales.

Exceptions: customized goods, hygiene or personal-use products once opened, or other items which, for health or safety reasons, cannot be returned.

Return shipping costs are borne by the customer, unless otherwise required by law.

Refunds will be made to the same payment method used for the purchase, within a maximum of 14 days from receipt and inspection of the returned item.

Legal warranty (where applicable)

In Spain and the European Union, the legal conformity warranty applies with the duration and conditions established by the applicable regulations.

TheBrickBlaster will comply with all applicable legal warranty and consumer protection obligations based on your country of residence and delivery.

TheBrickBlaster commercial warranty (90 days)

In addition to statutory consumer rights, TheBrickBlaster offers a voluntary 90-day commercial warranty from delivery, covering manufacturing defects.

Conditions: the product must be unused, in its original condition and complete (with packaging and accessories).

Return shipping costs under this commercial warranty are borne by the customer.

If a manufacturing defect is confirmed, TheBrickBlaster will refund the price of the product (excluding shipping costs), or may, at its discretion, replace it with an identical or equivalent item, subject to availability.

  1. Intellectual property

All content on the site, including text, images, logos, code and trademarks, is the property of TheBrickBlaster or used with the authorization of its owners.

You may not reproduce, distribute, modify, exploit or use any site content without TheBrickBlaster’s prior written consent, except where permitted by law (for example, private copies for strictly personal use).

  1. Third-party tools and links

We may provide links or integrations to third-party websites and services (for example, payment gateways, shipment tracking platforms, etc.).

Use of these tools or third-party links is voluntary and at your own risk.

TheBrickBlaster is not responsible for the content, privacy policies or practices of such third parties.

  1. Relationship with Shopify

Our online store runs on the Shopify platform, but all sales are made directly by TheBrickBlaster.

Shopify is not responsible for our products, transactions, or any disputes that may arise between TheBrickBlaster and customers.

  1. Privacy and data protection

We process your personal data in accordance with our Privacy Policy, which explains how we collect, use and protect your information.

By using our site, you consent to the processing of your data for:

  • order and shipping management,

  • customer support,

  • marketing communications (where you have consented),

  • fraud prevention,

  • compliance with legal obligations.

For residents of the European Union, data processing is primarily governed by Regulation (EU) 2016/679 (GDPR) and applicable national laws.

If you reside outside the EU, you may have additional privacy rights under the laws of your country; these will be outlined or complemented in the Privacy Policy.

  1. User reviews and submitted content

By submitting reviews, photos or other content (“User Content”), you grant TheBrickBlaster a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce and display such content for promotional, commercial or operational purposes related to our products and services.

You warrant that you own the rights to the User Content you submit and that it does not violate any law or third-party rights (including intellectual property, privacy or image rights).

  1. Errors, inaccuracies and omissions

We may correct typographical errors, pricing mistakes, description errors or other information on the site or in orders at any time.

If an order is affected by an obvious pricing or description error, TheBrickBlaster may cancel the order, inform you, and refund any amount paid.

  1. Prohibited uses

You agree not to use the website or services to:

  • engage in unlawful, fraudulent or bad-faith activities,

  • upload or transmit viruses, malware or any malicious code,

  • attempt to breach, test or circumvent our security measures, systems or networks,

  • bypass technical or legal restrictions on our services.

Violation of these rules may result in suspension or cancellation of your account and, where appropriate, legal action.

  1. Termination

TheBrickBlaster may suspend or terminate access to the services in case of violation of these Terms or applicable law.

Obligations and responsibilities incurred prior to the termination date will continue to be enforceable.

  1. Disclaimer of warranties

Except to the extent required by law, TheBrickBlaster’s services and products are provided “as is” and “as available”.

TheBrickBlaster does not provide additional express or implied warranties beyond those required by law and those explicitly set out in these Terms or in the product information.

  1. Limitation of liability

To the fullest extent permitted by applicable law, TheBrickBlaster shall not be liable for indirect, incidental, special or consequential damages arising from the use (or inability to use) the website or products.

This limitation does not apply where prohibited by consumer protection laws, particularly in cases of:

  • personal injury caused by defective products, or

  • willful misconduct or gross negligence by TheBrickBlaster.

  1. Indemnification

Except where the damage is solely attributable to TheBrickBlaster, you agree to indemnify and hold harmless TheBrickBlaster, its affiliates and employees from any claims, losses or expenses arising from:

  • your breach of these Terms, or

  • your violation of applicable laws or third-party rights.

  1. Severability

If any provision of these Terms is held invalid or unenforceable by a court or competent authority, the remaining provisions will continue in full force and effect to the extent permitted by law.

  1. Entire agreement

These Terms, together with our other published policies (including the Privacy Policy, Returns, Warranty and Refund Policy, Shipping Policy and Legal Notices), constitute the entire agreement between you and TheBrickBlaster regarding the use of the website and the purchase of our products.

  1. Assignment

You may not assign or transfer your rights or obligations under these Terms without TheBrickBlaster’s prior written consent.

TheBrickBlaster may assign its rights and obligations in the event of a merger, business sale, reorganization or similar transaction, while always respecting consumer rights and applicable regulations.

  1. Governing law and jurisdiction

These Terms are governed by Spanish law, without prejudice to mandatory consumer protection rules of other countries where applicable.

In case of dispute, and where the customer is a consumer resident in the European Union, claims may be brought before the courts of the consumer’s domicile or before the competent Spanish courts, as permitted by law.

The consumer retains in all cases their non-waivable rights recognized under the consumer protection laws of their country.

Section headings in these Terms are provided for convenience only and do not affect their legal interpretation.

  1. Changes to the Terms

TheBrickBlaster may update these Terms at any time by publishing a new version on savenor.com.
Continued use of the site after publication of the new version implies acceptance of the updated Terms.
